Code Holder Terms
The conditions on which an EBRICS code is issued and held, covering the holder's declarations, custody duties, correct use of ATVs and seals, and the Registry's rights to suspend, re-issue and revoke.
1. Application and issuance
- By submitting an application, the applicant (the "Holder" once a code is issued) agrees to these terms and to the Verification Standard.
- The person submitting confirms that they are authorised to act for the entity, and that all information and documents provided are true, complete and not misleading.
- The Registry decides at its discretion whether to issue a code. Tier, Reserve List designation, verification status, compliance clearance and VIC are determined by the Registry alone and cannot be purchased, negotiated or self-declared.
- The code is issued to the entity, not to an individual, and remains the property of the Registry. The Holder receives a revocable right to use it in accordance with these terms.
2. Custody of the code and mailbox
The code, together with the registered mailbox, allows the Holder to authorise verifications and seal documents. The Holder must:
- restrict knowledge of the full code to persons who need it;
- protect the registered mailbox with strong authentication, and never forward Registry confirmation links;
- tell the Registry immediately at compliance@eurabeltfuels.com if the code or mailbox may have been compromised, so the code can be suspended and re-issued;
- keep the registered email address current. A change of mailbox requires re-verification of the authorised contact.
3. Using the code
The Holder may place its code on documents it issues, as set out in the Document Seal Policy. The Holder must not:
- place its code on documents issued by, or on behalf of, any other party;
- license, lend, sell or disclose its code for use by another person;
- represent that the Registry is a party to, recommends or guarantees any transaction;
- state or imply a tier, Reserve List position or status other than the one currently recorded.
4. Authorizations to Verify
- The Holder decides who may verify its profile. Each ATV is addressed to a named counterparty, is valid for 24 hours to 14 days, and permits 1, 3 or 5 verifications.
- The Holder consents to the Registry disclosing its verified profile, as described in the Privacy Notice, to each counterparty it authorises.
- The Holder is notified of each verification and may revoke an ATV at any time before it expires.
5. Accuracy and changes
The Holder must notify the Registry within 10 business days of any change to its ownership, directors, authorised signatories, registered details, mandate or sanctions exposure. Changes to sealed facts result in re-issue of the code.
6. Suspension, re-issue and revocation
The Registry may suspend, re-issue or revoke a code where:
- the Holder no longer meets the Verification Standard;
- information supplied proves inaccurate or incomplete;
- the Holder breaches these terms or the Acceptable Use Policy;
- a compromise of the code or mailbox is suspected;
- screening identifies a potential or confirmed sanctions match;
- continued registration would be unlawful or would expose the Registry or counterparties to material risk.
Where lawful and practicable, the Registry gives reasons for a suspension or revocation. Decisions may be appealed under the Complaints & Appeals procedure. When a code is suspended, revoked or superseded, all outstanding ATVs are withdrawn.
7. Fees
Any fees for registration or renewal are set out in the Holder's engagement terms with Eurabelt Fuels Ltd. The Registry never requests payment by email reply, telephone or messaging app.
8. Ending registration
The Holder may ask the Registry to revoke its code at any time. Ledger records are retained as described in the Data Retention Schedule, because the integrity of past verifications depends on them.
9. Liability and indemnity
The Holder indemnifies Eurabelt Fuels Ltd against losses arising from inaccurate information it supplied or from its misuse of its code. The Disclaimer & Liability policy applies.
10. General
These terms are governed by the laws of England and Wales, and the Terms of Use apply in addition.
